While I agree that muslims have the total right to build where they wish as long as all codes and local, state, and federal laws are abided by, I only question their wisdom to build so close to a site that will cause most Americans animosity toward muslims. To me, this is just stirring the pot for more hurt and yes bloodshed to come. What the city of New York should have done, was to enact ordinances to discourage any and all types of religious establishments so close to such "hallowed" ground as this is.

The only way a government can take action against its' citzens is to make laws. Laws = "the State". If laws are made infringing upon religion (aka "The Church") for the sole purpose of preventing religion from free worship, then the line separating Church and State is erased.

Now--under the law, if a religious group built a faulty building that threatened public safety, then yes--that group breaks the law and the housing commissions can step in, absolutely. If that's the case--they're not going after how they worship, they're presiding over what they're responsible for--the sound building of a place of worship so it's parishoners are safe.

When it comes to saying we'll make a law so no churches can be built in a particular area, you're infringing upon the right of a religion to build a place of worship, which infringes upon their right to worship--only because you don't want them worshipping that religion there. That violates the separation of the two IMO, and is thusly wrong and unconstitutional.
